SCOPE OF APPLICATION

The present General Sales Conditions of the penile extender andropenis® only apply to sales made through this website. They cannot be applied to any purchase of the above mentioned penile extender made via any other sales channel or distributor.

PRICE

The price will be that which is at any moment in time published on the respective websites created by Andromedical S.L. for each country. The price will include tax when applicable.

The price does not include, in any case, the additional taxes and/or tariffs that national legislation imposes in the country where the penile extender andropenis® is to be sent. These will have to be paid by the purchaser of the extender.

CONDITIONS OF PAYMENT

The conditions of payment will be those that are at any moment in time published on the respective websites created by Andromedical S.L. for each country.

TIME AND CONDITIONS OF DELIVERY

Delivery time and the transport company used will vary relative to the final destination. You will be able to consult this data on the website created for your country by Andromedical, S.L. In any case, the calculation of delivery time for the order will start when Andromedical S.L. has received the payment in full.

When the product is delivered, you will have to sign an accredited document which certifies that you have correctly received the product and there are no visible defects. In the case that you notice any external damage, you will have to properly explain this on the delivery note and let Andromedical S.L. know within the next seven days after the date of delivery.

GUARANTEES

The penile extender andropenis® has the following guarantees:

• Medical Guarantee:
  Class 1 Medical Device, approved by the sanitary authorities of the European Union and the Spanish Ministry of Health, with CE branding, according to the tests realised in conformity with the Helsinki Declaration. Likewise, it is approved in Canada, Australia, Switzerland, Norway, Russia, Ukraine, Kazakhstan, and Taiwan.
  Andropenis® is manufactured in compliance with European Union legal directives, using medical grade materials of the highest quality, suitable for continuous contact with human skin.
  Andromedical possesses, amongst others, the ISO 10993 Quality Standard: “Biological Evaluation of Medical Devices᾿ which certifies that andropenis® has successfully exceeded the most rigorous biocompatibility tests, according to standardised criteria, before its commercialisation.
• Scientific Guarantee: Extends to its three different applications.
  
  1. The penile extender is prescribed for penis enlargement, through an adaptative and progressive traction force. It is based on the tissues´ reactive capacity when submitted to a traction force, which results in cellular multiplication. The principle of traction is also applied to tissue expansion in plastic surgery; this expansion is generated by the skin in order to cover cutaneous defects, burns or bald spots. It is also applied in bone distraction for the elongation of osseous diafisis of members.
     According to the studies carried out in the field of Andrology, the efficacy of andropenis® is of 97.5%. The group of patients composed of the 2.5% of those who did not obtain the desired results, can be explained by three fundamental reasons:
     - Hypersensibility of the penile mucosa
     - No adaptation of the patient, in his daily life, to the penile extender.
     - Low levels of testosterone and/or GH (growth hormone).
     In these cases, no growth is produced, or if it can be produced, it is inferior to the average of treated patients.
     
  2. The medical device andropenis® is also used to correct penile curvature provoked by Peyronie disease, achieving a correction of up to 40%. In these cases the penis will also be elongated and enlarged, but to a lesser extent because of the existence of the curvature.
  3. The medical device andropenis® is also used in post-surgery processes, to prevent scar retraction, as well as the penile shortening secondary effect, which takes place after all urological surgeries.
• Manufacturer´s Warranty:
  Andropenis® is manufactured according to the health sector’s most stringent quality standards, allowing it to offer a 1 year manufacturer’s guarantee (24 months for European Union countries) and a 7 day contract cancellation period. The calculation of this period will begin the day after andropenis® is received by the client. The manufacturer’s guarantee will only be applicable if the client is in possession of the original invoice or sales receipt (stating the date of purchase and Serial Number), andropenis® (excluding disposable parts) and the original packaging.
  As per the Directive 93/42/EEC, concerning medical devices, and in accordance with the ISO 13485:2003 Quality Standard, the buyer should send this guarantee, fuly completed and signed, to the following postal address: Andromedical S.L., c/ Proción 7, 28023, Madrid, Spain (España).
• Right of Money-back Guarantee:
  Andropenis® is manufactured according to the medical sector's most stringent quality standards, which allows to offer the client a 60 day contract cancellation period to be refunded the money paid for Andropenis®, beginning the day after the product is received. This 60 day cancellation period will only apply when Andropenis® is purchased directly from the manufacturer (Andromedical S.L.) and if the original invoice or sales receipt (stating the date of purchase and Serial Number), Andropenis® (excluding disposable parts) and the original packaging are sent back to Andromedical S.L. (Postal address: C/ Proción 7, 28023, Madrid, Spain). Andromedical, S.L. will effect the refund to the client in a maximum period of 30 days, beginning the day after the device is received by Andromedical S.L. The refund method will be bank transfer, save in the case Andromedical S.L. has the necessary details to refund to the credit card the client paid with. Purchases made through distributors or affiliates, not directly from Andromedical via its client service phone centre or the websites www.andromedical.com o www.andropenis.com, are expressly excluded from the aforementioned guarantee.

INFORMED CONSENT

With the acceptance of the present Sales Conditions, you recognise and admit knowing the characteristics, forms, contraindications, and precautions you need to adopt in order to correctly use the andropenis®.

I declare to know the following indications and the existence of health risks if I do not use the penile traction device strictly following the instructions submitted with the device:

I know that if I overly tighten the silicone band on the groove of the glans and/or if I don´t take the prescribed breaks (every two hours or each hour in advanced stages of treatment) retentions of blood can be produced at the top of the penile head.

I know that it can worsen the symptoms of infections located in the penis if I do not suspend the use of the penile extension device until the infection has completely healed.

I know that if my penile mucosa is very sensitive there can appear erosions or wounds in the base and or groove of the head and that, in this eventuality, I have to suspend the use of the penile extension device until it has completely healed.

I know that an inappropriate adjustment or an exaggerated regulation of the traction in an inadequate phase can provoke pain, numbing and whitening of the glans.

Amongst the situations to be taken into account, the patient must ensure that his state of health, previous to the treatment, does not represent any medical contraindication to the treatment.

It will be assumed that you have understood and accepted the presented clauses and that you have full knowledge of these clauses through the information contained within them from the moment that you make the acquisition of the penile extender andropenis®. Likewise, you give informed consent on the risks of misusage of the acquired device.

JURISDICTION

For whatever complaint against Andromedical S.L., the Court of Madrid (Spain) will be held competent, therefore renouncing the parts to any other jurisdiction that may apply.
